Judgment in Xena Systems Limited v Conquip Industrial and Cantideck

On 4 August 2011 Cantideck and Conquip Industrial submitted to judgment on liability in case number ICL70035 in the Patents County Court, in respect of their infringement of Xena Systems Limited's European Patent (UK) 1 392 939 (the "Patent") relating to rolling platforms for material movement during construction which allow efficient and safe movement of loads direct from transport to point of use in multi storey buildings.

The platforms were originally conceived, designed and developed by Xena Systems Limited in 2004 and subsequently a patent was granted in Europe.

The court has ordered Cantideck and Conquip Industrial not to infringe the Patent in the future. In addition Cantideck and Conquip Industrial have agreed to pay damages to Xena Systems Limited or, at their option, to account to Xena Systems Limited for the profits gained by their infringement of the Patent. Cantideck and Conquip Industrial will also pay legal costs.
